İslam Hukukunda çocuk düşürme

Abstract

“İslam Hukukuna Göre Çocuk Düşürme” adlı tezimiz, günümüzde oldukça güncellik kazanmış konulardan biri olan ve hükmü merak edilen çocuk düşürmenin, İslam hukuku açısından incelenmesi amacıyla yapılan bir çalışmadır. Tezimiz, kısa bir giriş ve iki bölümden oluşmaktadır. Birinci bölümde, anne karnındaki çocuğun, yani ceninin mahiyeti ve hukukî durumu ile kendisine tanınan kişilik hakları ortaya konulmaya çalışılmıştır. İkinci bölümde ise, önce çocuk düşürmenin İslam hukukuna göre hükmü ele alınmış, daha sonra söz konusu suç, İslam ceza hukuku açısından incelenerek bununla ilgili düzenlenmiş olan cezalardan söz edilmiştir. Sonuç olarak, anne karnındaki cenine sınırlı hak ehliyeti tanındığı ve böylece insan kişiliğinin anne karnındaki doğum öncesi süreçten itibaren hukuken koruma altına alındığı belirtilmiştir. Diğer yandan, anne karnındaki cenini düşürmenin, gebeliğin ilk günlerinden itibaren, belirli ve özel zorunlu durumlar dışında, İslam hukukuna göre suç olduğu ortaya konulmuştur.

Our thesis, “ The Abortion According To İslamic Jurisprudence”, aims to inspect the abortion that it has acquired currency fairly today from the perspective of islamic jurispuridence. Our study has a short introduction and two main chapters. In the first chapters, it was tried to expose nature and jüridical case of fetus namely child in uterus of mother, separately personality justices was attributed to him. In the second chapter, it was inspected sway of abortion according to islamic jurispuridence firstly, there after, it was investigated this crime from the perspective of islamic criminal law and the sanctions concerned that crime was discussed. Consecuently, it had been clear that he was attributed definite justice competence to fetus in the uterus of mother and that thus it was protected human personality beginning from previous of confinement in the uterus of mother. Separately, it had been expose that abortion is a crime beginning from first days of pregnancy except for spesific and imperative cases according to islamic jurispuridence.
