İslam hukukunda kadının mülkiyet hakkı ve malı üzerinde tasarruf ehliyeti

Abstract

"İslâm Hukukunda Kadının Mülkiyet Hakkı Ve Malı Üzerinde Tasarruf Ehliyeti" isimli tezimiz bir giriş ile iki bölümden meydana gelmektedir. Giriş bölümü araştırmanın amacı, önemi, kaynaklarının değerlendirilmesi, sunulması ve yönteminden oluşmaktadır. Birinci bölümde mülkiyet kavramının mahiyeti, mülkiyet ile ilişkili olan mal, ihraz ve ihtisas kavramlarını açıklanmaya çalışıldı. Mülkiyetin temellendirilmesi ve kadının mülkiyet hakkı; Kitap ve Sünnete dayanarak, kadının mülk edinme kaynaklarından; kadının çalışması, mehir, nafaka, miras ve hibe haklarını ele aldık. İkinci bölümde, öncelikle ehliyet kavramının mahiyetini ve ehliyetin buluğ, rüşt kavramlarıyla ilişkisi bağlamında buluğ ve rüşt kavramlarının tanımını vermeye çalıştık, daha sonra kadının malî velâyeti ve mal üzerinde tasarruf ehliyeti ile ilgili Cumhurun görüşünü ve Malikilerin görüşünü delilleriyle beraber sunarak açıkladıktan sonra, kadının malından nafaka verme yükümlülüğü üzerinde durduk. Sonuç bölümünde ise, araştırmamızda, ulaşılan neticelere yer verdik.

Our research, under the title "The woman's right of ownership and capacity to use her property under islamic law" apart from introduction, it consists two sections. The introduction explains the purpose of the research, importances, assessment of its resources and tools, as well as its methodology and presentation. In the first chapter, we explain on the nature of the concept of ownership, the relationship between the concepts of: property, acquisiton and possession. We also discuss the bases of ownership, and woman's ownership rights; basing on the Quraan and the Sunnah, from the woman's ownership rights; right to work, dowery, maintenance, inheritence, gift and inter vivo. In the second chapter, we first worked to give the meaning on the essentials of the concepts of competency in contextual relation to the concept of the age of puberty and majority. Subsequently, after explaining with clear evidences on custodian of woman to property and capacity to use, in relation to; Maliki school of thought and Consensus opinions, we put emphasis on the obligation of woman to give maintanance from her own property. In the conclusion, we have included the result achieved of our research.
