Hanefî ictihad usûlünde ıtlak ve takyid

Abstract

Bu çalışma usûl sistematiği açısından Hanefî mezhebi ile diğer mezheplerin farklı görüşlere sahip olduğu mutlak ve mukayyed lafız anlayışı ve ıtlak ve takyid prensibinin Hanefî mezhebinde nasıl uygulandığını ortaya koymayı amaçlamaktadır. Araştırma bir giriş ve üç bölümden oluşmaktadır. Girişte araştırmanın konusu, kaynakların tespiti ve kullanılmasında takip edilen metod ve çalışmaya verilen ismin tercih sebeplerine yer verilmiştir. Birinci bölümde Kur'ân-ı Kerîm ve Sünnet'i dil ve ifade analizi ile inceleyen usûl ilmi açısından mutlak ve mukayyed kavramların mahiyetlerinin tespiti üzerinde durulmuştur. İkinci bölümde Hanefî mezhebinin ıtlak ve takyid anlayışı ve diğer mezheplerle aralarındaki anlayış farkı incelenmiştir. Üçüncü bölümde de Hanefî mezhebinin mutlak ve mukayyed lafızlara ilişkin kabul ettikleri prensiplerin fer'i meseleler üzerinde nasıl uygulandığı Şemsü'l-eimme Serahsî'nin el-Mebsût adlı eseri esas alınarak ortaya konmuştur. Uygulama örnekleri ile ilgili değerlendirmenin ardından bütün inceleme boyunca ulaşılan sonuçların bir araya getirildiği "Sonuç" ve "Kaynakça" ile araştırma son bulmuştur.

This study aims to shed light on the differing methodological views of absolute (mutlaq) and restricted (muqayyad) words (al-alfâz) between Hanafi shcool of law and other shcools of law and how itlaq and thaqyid principles are applied in the Hanafi school of law. This study is composed of an introduction and three additional chapters. Introduction chapter covers the topic, important issues while researching the topic, methodology in review and reuse of the literature, and the reasons behind the title choice for this study. The first chapter of the study focuses on determining the concepts of absolute (mutlaq) and restricted (muqayyad) from the perspective of the science of methodology, which linguistically and expressively analizes the Qoran and Sunnah. The second chapter of the study focuses on the interpretation of ıtlaq and takyid by the Hanafi school of law and their differences with other schools of law. The third chapter of the study explains how Hanafi school of law's accepted principles regarding the absolute (mutlaq) and restricted (muqayyad) words are applied to legal issues by giving examples from the masterpiece Kitab al-Mabsut by Shamsu'l-aimme Imam Sarakhsi. After the evaluation of the applied examples, the paper has ended with the "Findings" section, in which all our arguments throughout the study are compiled, and finally with the "Bibliography".
