Tefsir ve fıkıh bağlamında tesettür ayetlerinin değerlendirilmesi

Abstract

Tesettür, Yüce Allah’ın kullarına emretmiş olduğu dini bir yükümlülük olmasının yanı sıra aynı zamanda hem fıtri ve hem de ahlaki bir vecibedir. Tesettür hükümleri Kur’an ve sünnetle açıklanmıştır. İlgili kaynaklara müracaat eden âlimler ise bunları tefsir ve fıkıh kitaplarında derinlemesine işlemişlerdir. Bu çalışmada güdülen temel amaç; ilgili tesettür hükümleri hakkında açıklama yapan müfessir ve fakihlerin söz konusu hükmün inşasında takip ettikleri metot ve vardıkları esas maksadın tespit ve analizini yapmaktır. Bu bağlamda ilgili hükümler temelde sadece yabancı erkek ve yabancı kadınlar hakkında konulmuş tesettür ilke ve hükümleri üzerinden açıklanmaya çalışılmıştır. Tesettür hükümleri üzerinde duran âlimler farklı metot ve hükümler tespit etmişlerdir. Ancak bu farklılıkların birçok nedeni olmakla birlikte âlimlerin, çoğunlukla söz konusu hükmün temel maksadı hakkında birleştikleri gözlemlenmektedir. Nitekim âlimler arasındaki birtakım ihtilaflar bazen sadece ilgili hükmün lafız ve illetleri bakımından farklılaşmış olabilmektedir. Bu hususun en çok tezahür ettiği hükümlerden biri de tesettürdür. İlgili çalışmalarda, hem tefsir hem de fıkıh kaynaklarındaki birçok örneklerde gözlendiği üzere âlimlerin, kimi âyet ve hükümler hakkında farklı beyan ve ıstılahları tercih etmesine rağmen söz konusu hükmün temel amaç ve pratiğinde birleştikleri hakkında tespitler yapılmaktadır. Bu bağlamda arada birtakım nüans farklılıkları olmakla birlikte yapılan pek çok analizde, benzer sonuç elde edilmekte olup bu tez çalışmasında da, bunların nedenleri üzerinde durulmaktadır.

In addition to being a religious obligation commanded by Almighty Allah to his servants, hijab is also a natural and moral obligation. The rules of hijab are explained by the Qur'an and Sunnah. Scholars who consulted the relevant sources, on the other hand, covered them in depth in the books of tafsir and fiqh. The main purpose pursued in this study is to determine and analyze the main purpose the mufassirūn and fuqaha who make explanations about the relevant hijab rules reached and the method followed by them in the construction of the said rules. In this context, the relevant rules were tried to be explained on the basis of the principles and provisions of hijab, which are basically only about non-mahram men and non-mahram women. Scholars who dwell on the rules of hijab have determined different methods and rules. However, although there are many reasons for these differences, it is observed that scholars mostly agree on the main purposes of the said rule. As a matter of fact, some disagreements among scholars may sometimes differ only in terms of the wording and causes of the relevant rule. One of the rules in which this issue is most manifested is hijab. In the related studies, as seen in many examples in both tafsir and fiqh sources, determinations are made that although scholars prefer different statements and terms about some verses and rules, there is a consensus among them on the main purpose and practice of the said rule. In this context, although there are some nuance differences, similar results are obtained in many analyzes and in this thesis, the reasons for these are emphasized.
