Karşılaştırmalı ülke incelemeleri bağlamında Türk kamu yönetiminde ombudsmanın uygulanabilirlik analizi

Abstract

Ombudsman, kökeni 18. yüzyıla kadar dayanan ve kamu yönetiminin devlet adına denetlenmesi için ortaya çıkmış bir kurumdur. Ombudsman, günümüzde neredeyse tüm çağdaş devletlerde kurulmuştur ve bu kurum dünya boyunca yayılımını devam ettirmektedir. Ombudsman, özellikle demokrasi ve hukuk devleti ilkeleri ile özdeşleşmektedir. Bu bağlamda da günümüzde tüm dünya devletlerinin ilgisini çekmektedir. Günümüzde devletin ve kamu yönetiminin artan eylem ve faaliyetlerine karşılık olarak topluma sunmuş olduğu görev ve hizmet düzeyinde artışlar meydana gelmiştir. Bu çerçevede devletin artan hizmetlerine bağlı olarak denetimi de önemli bir konu haline gelmektedir. Bu tez çalışmasının konusunu meydana getiren ombudsman da bu sebeplerle kamu yönetiminin denetlenmesi için ortaya çıkmış bir denetim sistemidir. Türkiye'de ombudsmanın veya ombudsmanlık kurumunun uygulanabilirliğini araştıran bu tez çalışması, Türkiye'de bir ombudsmanlığın kurulmasındaki içsel ve dışsal gerekçeleri derinlemesine analiz etmektedir. Bu çerçevede tezin ana hipotezi de bu gerekçeler bağlamında uygulanabilirlik üzerine dayandırılmıştır. Tez çalışmasının ilk bölümünde kamu yönetiminin denetlenmesi üzerinde durulmaktadır. İkinci bölümde ombudsmanlık kurumu kavramsal ve teorik boyutta açıklanmaktadır. Üçüncü bölümde seçilmiş ülke örnekleri çerçevesinde farklı ombudsmanlık kurumu uygulamalarına ve karşılaştırmalarına yer verilmiştir. Çalışmanın dördüncü bölümünde ise Türkiye'de bir ombudsmanlık kurumunun kurulmasını gerektiren içsel ve dışsal gerekçeler, ombudsmanlık kurumu kurma girişimleri, ombudsmanlık kurumunun uygulanabilirliği konularına yer verilmiştir. Çalışmanın son bölümünde ise ombudsmanlık kurumunun Türkiye'de uygulanabilirliğine ilişkin bir alan araştırması yer almaktadır.

Ombudsman, origin 18 dating back to centuries and emerged for the inspection of the public administration is an institution on behalf of the state. The Ombudsman was established in nowadays almost all modern states and these institutions continues to spread throughout the world. The Ombudsman, in particular is synonymous with democracy and the rule of law. In this context, today is attracting the attention of all the world's governments. Nowadays, increasing the actions and activities of the public administration of the state and society, which is submitted in response to the increase in duties and level of service has occurred. In this context, depending on the state's increasing control services are becoming an important subject. Which form the subject of this thesis that the ombudsman reasons emerged for the inspection of the public administration is a control system. This study investigates the feasibility of ombudsman or ombudsman institution in Turkey, establishing an ombudsman in-depth analyzes internal and external reasons. In this context, the main hypothesis of this thesis was based on this rationale in the context of applicability. In the first part of the thesis focuses on the auditing of public administration. In the second part of ombudsman is described in the conceptual and theoretical dimensions. Examples of selected countries in the framework of the third chapter of ombudsman different applications and comparisons are given. In the fourth part of the study in Turkey which require the establishment of an ombudsman internal and external reasons, attempts to establish an institution of ombudsman, ombudsman institution and practicality of a field study of the feasibility of these institutions are located. In the final part of the study of the ombudsman institution in Turkey is located in a field study of the feasibility.
