Çin ve Türk Ceza Hukukunda uyuşturucu veya uyarıcı madde suçları

Abstract

Uyuşturucu veya uyarıcı madde üretimi, kaçakçılığı, ticareti, kullanımı ve ilgili suçlar her ülkenin geleceği için büyük tehlike sayılıyor. İnsan ve toplumun sağlığına ciddi tehdit etmekte olan uyuşturucu veya uyarıcı maddelere karşı savaşmak uluslararası ve ulusal görev olmaktadır. Bu nedenle konu önemini her zaman taşımıştır. Uyuşturucu veya uyarıcı madde suçları sadece ceza hukuku alanında araştırılmaktansa bütün toplum ve her alan buna karşı ortak çözüm bulmak için araştırmalar yürütmektedir. Madde kullanımının önlenmesi ve denetlenmesi için uluslararası hukukta düzenlemeler yapılmakta. Türk ve Çin mevzuatlarında özel kanun ve ceza hukukunda düzenlemeler mevcüttür. Türk ve Çin hukuku kara avrupası hukuk sistemine ait olsa da uyuşturucu veya uyarıcı madde suçlarındaki değerlendirmelerde farklar bulunmakta. Türk mevzuatında madde imal ve ticareti suçları ağır cezaya tutulurken, Çin mevzuatında madde imal, kaçakçılık, ticaret ve nakletme suçları ağır cezaya tutulmaktadır. Çalışma Türk ve Çin mevzuatında uyuşturucu veya uyarıcı madde suçları ile ilgili düzenlemeleri araştırmak ve değerlendirmek amacıyla hazırlanmıştır. Birinci bölümünde uyuşturucu ve uyarıcı maddelerin kavramı, türleri, Uyuşturucu veya uyarıcı maddeler ile ilgili uluslararası çalışmalar, Çin ve Türkiye' deki tarihi gelişim boyutu ele alınmıştır. İkinci bölümünde, Çin Ceza Kanunu'nda uyuşturucu veya uyarıcı madde ile ilişkin suçlar ,suç içerikleri ve ilgili düzenlemeler değerlendirilmiştir. Üçüncü bölümünde, Türk Ceza Kanunu'nda uyşturucu veya uyarıcı madde suçları ve ilgili düzenlenmiş maddeler değerlendirilmiştir.

Drugs or stimulant drugs production, smuggling, trade, use for the future of the country creates a greate danger. It causes serious danger of person and society. The arrangements have been done to take control of using drug or stimulate in the international jurisprudence. Because of this the subject always keep its important. Drug or stimulant drugs problem the problem is not only criminal law. Whole society, every part of society to find a common solution to this problem must work together. For take control of using drugs or stimulant drugs, the international jurisprudence have been done some rules to control it. Republic of Turkey, Republic of China have their special law and criminal law for control the drug crime. Even though the system of law in this country is common law system, but regulation of drugs could have been different. In Turkish law producting or trading drugs or stimulant drug will be the heavily section of thıs criminal. But in Chinese law producting, smuggling, trading, using drugs or stimulant drugs will be the haveast section of drug criminals. Our study of the Chinese and Turkish Penal Code, drug or stimulant drugs and to evaluate and investigate the regulation of interest was prepared. The first part of this thesis, concept of drugs and stimulant drugs, types of drugs crime, historical development of Chinese and Turkish drugs crime has been taken up size. In the secong part of this thesis, the Chinese Penal Code in the field of drugs and stimulant drugs crime, drugs and stimulant drugs trial in criminal law issues have been addressed. In the third part of this thesis, the Turkish Penal Code in the field of drugs and stimulant drugs crime, drugs and stimulant drugs trial in criminal law issues have been adressed.
