İslam hukuku ve uluslararası hukuka göre mülteci hakları

Abstract

“İslam Hukuku ve Uluslararası Hukuka Göre Mülteci Hakları” adlı çalışmamız bir giriş kısmı ile üç bölümden oluşmaktadır. Birinci bölümde iltica ve mülteci kavramları ile mülteciyi ağırlamanın fazileti ve ekonomiye etkileri üzerinde durulmuştur. Ikinci bölümde, klasik fikih kaynaklarinda iltica ve mültecilerle ilgili hükümler hakkinda değerlendirmeler yapilmiştir. Üçüncü bölümde, islam hukuku ile uluslararasi hukukta mültecilerinin hak ve sorumluklari ele alinmiş olup akabinde mültecilerinin islam hukukunda ve uluslararasi yasalarda hak ve sorumluluklari arasinda karşilaştirma yapilmiştir. Akabinde de uluslararasi yasalara göre mültecilerin toplum ile entegrasyonu ile ilgili açiklamalar yapilmiştir. Yaptiğimiz çalişmada şu sonuca ulaşilmiştir: mültecilik ve siğinma insanlik tarihi kadar eski bir olgudur. Ancak kavrama olarak son yüzyilda ortaya çikmiştir. Bu yüzden islâm hukukunda bu kavram doğrudan karşiliği bulunmamaktadir. Mülteci statüsüne oldukça yakin olan kur’an ve sünnetten elde ettiği bazi kavramlari mevcuttur. Eman müessesesi mültecilik ve göçme kavramlarinin ilk şeklidir. Bu müessese gereğince, korumaya ihtiyaci olan, göç etmeye zorlanmiş herkese dini ya da irki dikkate alinmaksizin eman verilmelidir.

Our research, titled "Refugee Rights According to Islamic Law and International Law," is comprised of three sections. The first chapter emphasizes the ideas of asylum and refugee, the merits of hosting refugees, and the consequences of refugees on the economy. In the second section, assessments were conducted of the provisions in classical fqih texts relating to asylum and refugees. The rights and responsibilities of refugees in Islamic law and international law are examined in the third chapter, followed by a comparison of the rights and responsibilities of refugees in Islamic law and international law. Following that, explanations about the integration of refugees into society in accordance with international law were provided. The following conclusion was reached as a result of our research: refugees and asylum seekers are a phenomena as old as humanity itself. The concept, on the other hand, only emerged in the last century. As a consequence, this notion has no explicit equivalent in Islamic law. It has various concepts derived from the Qur'an and Sunnah that are quite similar to refugee status. Refugee and immigration principles begin with the protection of life and property. According to this instituion, life and property should be guaranteed to everyone who needs protection and has been compelled to migrate, regardless of religion or race.
