İlaç üreticisinin hukuki sorumluluğu

Abstract

İlaç kullanımından dolayı zarar gören kimselerin zararlarının tazmin edilebilmesi için ilaç üreticisinin sorumluluğuna başvurmaları gerekir. Hukukumuzda ilaç üreticisinin sorumluluğuna ilişkin ayrı bir kanun bulunmamaktadı. Bundan dolayı ilaç üreticisinin sorumluluğunun hukuki niteliği konusunda farklı görüşlermevcuttur. Bu doğrultuda sözleşmesel sorumluluk, haksız fiil sorumluluğu, TKHK kapsamında sorumluluk gündeme gelmektedir. Ayrıca 2021 yılında yürürlüğe giren7223 sayılı Ürün Güvenliği ve Teknik Düzenlemeler Kanunu kapsamında üreticinin sorumluluğuna ilişkin düzenlemeler, ilaç üreticisinin hukuki sorumluluğu konusunda yol gösterici olacaktır.

People who have been harmed due to the use of drugs should apply to there sponsibility of the drug manufacturer in order to be compensated for their losses.In our law, there is no separate law regarding the responsibility of the pharmaceutical manufacturer. There fore, there are different opinions about the legal nature of the responsibility of the drug manufacturer. In this respect, contractual liability, tort liability, liability within the scope of TKHK come to the fore. In addition, the regulations regarding the responsibility of the manufacturer within the scope of the Product Safety and Technical Regulations Law No. 7223, which entered into force in 2021, will guide the legal responsibility of the pharmaceutical manufacturer.
