Modern devlette özel hayatın gizliliği ve kişi güvenliği hakkının yarattığı çelişki ortamı

Abstract

Bu çalışma modern devletin benimsediği güvenlik anlayışının özel hayatın gizliliği hakkına etkisini incelemektedir. Devletin varlık sebebini güvenliğe dayandıran sözleşmeci teori ile teknolojik atılımların gölgesinde korunması giderek güçleşen özel hayat hakkının kesiştiği nokta çalışmanın genel yapısını belirlemektedir. Kavramların tarihsel gelişimi ile ele alındığı bu çalışma dört bölümden oluşmaktadır. İlk bölüm güvenlik kavramının tarihsel süreç içerisindeki gelişimine değinirken ikinci bölüm özel hayatın kapsamı, hak olarak tanınması ve hakkın koruduğu değerleri ele almaktadır. Güvenlik konusunda özellikle Thomas Hobbes’un Leviathan’ı ele alınmış ve günümüzün olağanüstü hali bağlamında değerlendirilmiştir. İkinci bölümde özel hayatın ayrı bir hak olarak tanınıp tanınmaması meselesi antropolojik değerlendirmeler ile temellendirilerek birey ve toplum için zorunlu olduğu sonucuna varılmıştır. Üçüncü bölümde ise güvenlik önlemlerinin özel hayat hakkına olan etkisi hukuki ve sosyolojik kavramlar üzerinden ele alınarak incelenmiştir. Güvenlik ve özel hayat hakkı ilişkisine dair çeşitli argümanlara yer verilmiştir. Daha sonra güvenlik önlemlerinin hak ihlallerine sebebiyet vermemesi için benimsenmesi gereken hususların altı çizilmiştir. Dördüncü bölümde ise konuya ilişkin bazı uluslararası ve ulusal yargı kararları incelenmiştir. Nihayetinde güvenlik ve özel hayat hakkı arasındaki dengenin önemine ve bu dengenin korunması için yapılması gerekenlere değinilen sonuç bölümü ile çalışma sonuçlandırılmıştır.

This study examines the impact of the personal security approach adopted by the modern state on the right to privacy. The intersection of contractarian theory, which bases the raison d’être of the state on security, and the right to privacy, which is becoming increasingly difficult to protect in the shadow of technological breakthroughs, determines the genereal structure of the study. This study, which deals with the historical development of the concepts, consists of four parts. While the first part deals with the development of the concept of personal security in the historical process, the second part deals with the scope of private life, its recognition as a right and the values protected by the right. On the subject of personal security, Thomas Hobbes’ Leviathan is discussed and evaluated in the context of today’s state of emergency. In the second part, the issue of whether or not private life should be recognized as a seperate right is based on anthropological evaluations and it is concluded that it is necessary for the individual and society. In the third part, the impact of personal security measures on the right to privacy is analyzed through legal and sociological concepts. Various arguments on the relationship between personal security and the right to privacy are addressed. Subsequently, the issues that should be adopted in order to ensure that personal security measures do not lead to violations of rights are underlined. In the fourth part, some international and national judicial decisions on the subject are analyzed. Finally the study is concluded with a concluding chapter on the importance of the balance between the need for security and the right to privacy and what needs to be done to protect this balance.
