NATO'nun Kosova'ya müdahalesinin Birleşmiş Milletler Kurucu Andlaşması açısından analizi

Abstract

Hazırlanan bu çalışma, NATO’nun Kosova’ya müdahalesini BM Kurucu Andlaşması çerçevesinde ele almaktadır. NATO’nun Kosova’ya karşı insani amaçlı müdahalesi, Birleşmiş Milletler Kurucu Andlaşması’nın temel ilkelerinden birisi olan ve ulus devletin özünde yer alan egemenliğin açık bir ihlalini oluşturması ve insan hakları, demokratikleşme, hukukun üstünlüğü gibi evrensel değerler karşısında devlet egemenliği ve onun ayrılmaz parçası içişlerine müdahale etmeme ilkesinin koruyuculuğunu kaybetmiş olması, bu çalışmanın ele aldığı argümanlar arasındadır. Egemenlik teorisi çerçevesinde ele aldığımız bu çalışma üç bölümden oluşmaktadır. Birinci Bölümde egemenlik teorisi ve BM Kurucu Andlaşması açısından devlet egemenliğine saygı çerçevesinde uyuşmazlıkların çözüm yolları ele alınmıştır. İkinci bölümde Birleşmiş Milletler Kurucu Andlaşması’nın sağladığı yetkiler çerçevesinde Bölgesel Örgütlerin ve NATO’nun uyuşmazlıkların çözümüne yönelik rolleri üzerinde durulmuştur. Üçüncü bölümde ise, NATO’nun Kosova’ya yönelik insani müdahalesi, BM Kurucu Andlaşması çerçevesinde devlet egemenliğini ihlal eden örnek olay olarak incelenmiştir.

This thesis analyzes the NATO intervention into Kosovo in the framework of the UN Charter. It is argued that the humanitarian intervention of NATO into Kosovo clearly violates the state sovereignty, which is one of the fundamental principles of the UN Charter, and takes places in the essence of nation-states. This thesis also claims that state sovereignty and the prohibition of intervention in a state’s internal affairs, inseparable part of the former, has lost its importance against the universal values such as human rights, democratisation, and the rule of law. This thesis consists of three main chapters. The first main chapter deals with the sovereignty theory and pacific settlement of disputes within the framework of the UN Charter. The second main chapter emphasizes the role of the NATO and regional organizations in the settlement of disputes within the authority taken by the UN Charter. The last chapter tries to prove that the humanitarian intervention of NATO into Kosovo is a violation of state sovereignty under the Charter of the UN.
