İngiltere'de kuvvetler ayrılığı ve yargı bağımsızlığı alanındaki gelişmeler: 2005 anayasa reformu

Abstract

Bu çalışma İngiltere'de 2005 yılında gerçekleştirilen anayasal reformun ortaya çıkardığı değişimi incelemektedir. Bu anayasal reform, esas itibarıyla İngiliz yargı organına kökten değişiklikler getirmiş ve yargı organını, kuvvetler ayrılığı ve yargı bağımsızlığı ilkeleri açısından çok daha ileri bir noktaya taşımıştır. Keza bu reform İngiliz anayasasının modern anayasacılık düşüncesi karşısında günümüzde geldiği noktayı ortaya koyması açısından da ayrıca önemlidir. Zira İngiliz anayasası artık geleneksel yapısından ödün vermekte ve giderek yazılı anayasalarınkine benzer bir yapıya bürünmektedir. Çalışmanın amacı, münhasıran söz konusu anayasa reformunu detaylı olarak incelemektir. Konunun en önemli kaynağı İngiliz Parlamentosu tarafından 2005 yılında kabul edilen Constitutional Reform Act (Anayasal Reform Kanunu) tir. Çalışmada söz konusu Kanunun ayrıntılı ve sistematik bir tahlili yapılmıştır. Zira İngiliz anayasa hukukundaki bu önemli reformun konusu bu Kanun ile İngiltere'nin yargı organında yapılan değişikliklerdir. Bunun yanında söz konusu reforma ilişkin İngiliz anayasa hukuku doktrininde ileri sürülen lehte ve aleyhte görüşler irdelenerek reform farklı açılardan da açıklanmaya çalışılmıştır. Konu incelenirken İngiltere'de niçin böyle bir anayasa reformuna ihtiyaç duyulduğu; bu reform yapılana kadar İngiliz anayasasının gelişiminin nasıl bir süreç izlediği; İngiliz anayasasındaki bu reform hareketinin etkilediği, değiştirdiği veya yeni ortaya çıkardığı kavram, kurumlar ve bütün bu değişikliklerin İngiliz anayasa hukukunda doğurması muhtemel sonuçlar açıklanmaya çalışılmıştır.

This thesis examines the transformation introduced by the constitutional reform of 2005 in England. This constitutional reform basically brought radical changes to the English judiciary and carried the judiciary forward in terms of priciples of separation of powers and judicial independence. Furthermore, this reform is also important in terms of revealing the point where the English constitution has come to in the face of contemporary constitutionalism. Because the English constitution has been making concessions to its traditional structure and becoming more likely to written constitutions. The purpose of this study is exclusively to examine this constitutional reform in detail. The most important source of the subject is the Constitutional Reform Act which was adopted by the English Parliament in 2005. A systematic and detailed analyse of the Act was made in the study because the subject of this important reform of the English constitutional law is the changes made in the English judiciary with this Act. On the other hand, this reform was explained in different terms by examining the arguments in the English constitutional law literature for and against this reform. While studying the subject it was tried to explain why this constitutional reform was needed; what kind of a development process has the English constitution followed; the concepts and institutions that have been affected, changed or introduced by this reform and the possible results that will be caused by all these changes.
